Termination

Your license to use the service will automatically be severed when terminated.

Liability Restrictions

Despite any damages you may incur, the aggregate amount of liability of the Company and any of its suppliers under any of these terms or your sole remedy in all of the above shall not exceed the amount you paid through the service, or, in the absence of any payments through the service, one hundred and no/100 USD.

The Company and its suppliers will not under any circumstances be liable to any special, incidental, indirect, or consequential damages of any sort, including but not limited to property damage, personal injury, and death, to the extent lawfully permitted. This does not include and is in addition to any damages of loss of profits, loss of information (data or otherwise), business interruption or personal injury or loss of privacy or loss of any other thing of any type or of any nature due to the use of the Service, third party software and/or third party hardware used with the Service and/or otherwise in connection with any provision of this Terms regardless of whether the Company or any supplier has been forewarned of the potential of damage or, in the event that the remedy fails to achieve its preeminent purpose.

Not all the limitations mentioned above will be imposed in jurisdictions where it is prohibited to exclude the implied warranties or to limit the liability that follows some incidental or consequential damages. The liability of each of the parties will be limited in such states up to the maximum limit possible under the law.

This does not exclude or limit any express or implied warranties of the foregoing, but neither the Company nor its providers makes any express or implied warranties, of any type whatsoever, as to: (i) the availability or functionality of the Service, or of the information, content and materials or products contained therein; (ii) the uninterrupted or error-free nature of the Service; (iii) the accuracy, reliability or currency of any information or material provided by the Service; or (iv) the freedom of the Service, the servers on which it is housed, the information, content and materials

Not all the above exclusions and limits may apply to you, as some countries prohibit the exclusion of certain types of warranty or the limits imposed on the rights of a consumer under the implied statutory guarantees. Nevertheless, in the given case, the restrictions and exclusions described in this section will be exercised to the maximum allowed by the corresponding laws.

Governing Law

The laws of the country will apply to this agreement, and this will govern your enjoyment of the service, except for the conflict of law provisions. This can include other local, state, federal or international laws to which your use of the application is subject.

Dispute Resolution

You agree to communicate with the company to endeavour to sort out any disputes or worries you might have about the service in an informal way.

To the Users of the European Union (EU)

As a consumer, you will enjoy any compulsory requirements of national laws of the country within which you reside, should you be a consumer of the European Union.

American Legal Compliance

You certify and warrant that: You are not located in a country that has been embargoed by the US government or that it has listed as a so-called terrorist-supporting country. You are not on any lists that either prohibit or restrict parties maintained by the US government.

Each of Waiver and Severability

Severability

Any one provision of these Terms that may be declared unenforceable or invalid will be changed and interpreted so as to fulfil its purposes as near as is legally possible, and the other provisions will continue to be wholly enforceable.

The waiver

Failure to enforce a right or seek performance of an obligation under these Terms by a party will not impair its ability to do so at any future date and a waiver by a party of a nuance of the Terms covenant implies no other waiver or infringement.

Analysis of Translation

In case we make these terms and conditions available to you through our service, it is possible that it has been translated. You agree that in case of a dispute the original English version is to prevail.

A Change in These Conditions

At any point, and our discretion, we reserve the right to modify these terms and update them. We are at liberty to decide on what constitutes a material change.

By continuing to use our service, you agree to be bound to the changed (new) terms. You can decide to stop using the service and the site, and to cease using it, in the event that you do not agree with all or part of the changed terms.
